Web-Nuk Website Design Terms & Conditions

1. 1.Web designing cost is onetime fee and will be cleared when all work is completed as agreed upon the agreement.
2. 2. If web space and domain has been purchased from Consultant (Web-Nuk) it has to be paid annually, if not paid on time site will be suspended and client will be responsible for delay in Payment.
3. 3. Consultant (Web-Nuk) will give online support for only 3 Months (Three months) from the time of completion of contract, for free on relating to change of text and modification of pictures in the website. Thereafter it will be charged according to nature of modification.
4. 4. Consultant (Web-Nuk) will be liable for any problem that is caused in website due to hackers and any problem in script of website for three months from the time of completion of contract undertaken specifically.
5. 5. Consultant will not provide any support for layout redesign once the design has been finalized during the contract.
6. 6. No refund will be made by consultant (Web-Nuk) once the work is completed and support is provided for three months (3 months) from the time of signing of contract.
7. 7. All text and pictures will be provided by client for website and if client wants any pictures from consultant it needs to be purchased.
8. 8.Consultant (Web-Nuk) will not be responsible for any copyright issue for text and pictures included in the website by the consultant (Web-Nuk) which has been forwarded by the client on his/her risk.
9. 9. In order to transfer domain from consultant (Web-Nuk) client has to provide one month notice in advance.
10. 10. Payment for domain and webhosting has to be made in advance and no excuses will be entertained if payment has not been made.
11. 11. If client want any domain to be purchased from consultant (Web-Nuk), client has to fill up the domain purchase form and domain will be booked according to the name provided in the form, and no refund will be made once domain has been booked by Consultant (Web-Nuk).
12. 12. If payment has not been made on time consultant (Web-Nuk) has all the right to suspend the site at any time.
13. 13. On handover of files from Consultant (Web-Nuk) to Client, the Client shall assume entire responsibility in ensuring that all files are functioning correctly before use.

Consultant reserves the right to terminate a project with a Client at any time without prior notification if it finds the Client in breach of these terms and conditions. Developer shall be the sole arbiter in deciding what constitutes a breach. No refunds are given in such a situation.
This agreement shall be governed by law of Bhutan which shall claim venue and jurisdiction for any legal motion or claim arising from this agreement. This agreement is void where prohibited by law.
Any and all matters pursuant to this agreement are governed by Law of Bhutan and are under exclusive jurisdiction of the Bhutan Court.
Consultant reserves the right to alter these Terms and Conditions at any time without prior notice,
By accepting a quotation or making a payment of invoice to use the services supplied, the Client acknowledges to have read, understand, and accept the Terms and Conditions of this Agreement, and agrees to be legally binding by these Terms and Conditions.

GENERAL

If the Agreement is canceled before the services are finished, Client forfeits initial deposit and may be held liable for breach of contract. If the client wishes to withdraw the contract after the services have been rendered, client will have to pay the full amount that was agreed upon by both parties. Any disputes arising from this contract will be litigated or arbitrated in the Court of Law. This Agreement shall be governed and construed in accordance with the laws of Bhutan. The undersigned hereby agree to the terms, conditions and stipulations of this agreement on behalf of his or her organization. This Agreement constitutes the entire understanding of the parties. Any changes or modifications thereto must be in writing and signed by both parties.
